CONTRACTING PARTIES

  1. the company Hotel Victoria s.r.o., with its registered office at Borská 19, 30100 Plzeň; the company is incorporated in the Commercial Register kept on file by the Regional Court in Plzeň, Section C, Insert 11242 (hereinafter "the Hotel")
  2. the Client – as a natural or legal person (hereinafter "the Client") These Terms and Conditions generally apply to all hotel Guests and Agencies with whom a written contract for services has not been agreed.

RESERVATION OF ACCOMMODATION AND SERVICES:

  1. Reservation of accommodation and other services in the Hotel and confirmation of this reservation by the Hotel shall be possible in writing, i.e. by email or by phone
  2. The reservation shall be considered valid and binding if the Hotel confirms such reservation to the Guest in writing, i.e. by email, or if an automatic email confirmation is generated by the relevant online reservation system.
  3. The reservation shall be completed using a payment card or by paying a deposit in the amount of the accommodation and services that are booked. Individual conditions can be provided for.
  4. In the event that the Hotel or Guest does not meet the conditions set out in clause 3, the Hotel shall not be obliged to provide accommodation and services.
  5. The information provided on the confirmation of the booking shall be binding on both Parties

PRICES, CANCELLATION AND PAYMENT TERMS:

  1. The price is set per room per night, including breakfast, unless the guest chooses otherwise.
  2. The price of accommodation includes VAT at 10%. A municipal tax of CZK 21.00 per person per night is included in the price.
  3. Cancellation of a confirmed reservation can only be made in writing, i.e. by email. The exact method of cancellation is determined by the reservation system that was used to make the reservation.
  4. When cancelling a reservation that was made through an external provider (e.g. booking.com), it is necessary also to cancel the reservation through that provider in the manner required under the terms and conditions by the provider and of the reservation.
  5. A change of reservation, i.e. a transfer of the services that were ordered to another date, shall be considered a cancellation of the original reservation and shall follow the same procedure as the cancellation of the reservation.
  6. Accommodation can be paid for in cash; we accept the CZK, EUR, USD, GBP and CHF currencies. In the event of payment by credit/debit card, the amount shall be charged in CZK, EUR or USD according to the currency selected.
  7. Under the Registration of Sales Act, the seller has the obligation to issue a receipt/bill to the Buyer. The seller shall also register the sale online with the tax authority, in the event of a technical failure no later than within 48 hours.
  8. The Hotel reserves the right to pre-authorize the Guest’s card up to the total amount of the accommodation.
  9. No fee shall be charged if the reservation is cancelled up to 24 hours before the date of arrival (applies to a standard reservation).
  10. In the event of a non-refundable reservation being chosen, the Hotel has the right to charge 100% of the accommodation price at any time after the reservation is made.
  11. In the event of the non-arrival of the Guest, the reservation shall be cancelled and the Hotel shall be entitled to charge the cost of the entire accommodation of the Guest

GUEST’S RIGHTS AND DUTIES:

  1. The Guest shall have the right to use the reserved areas and their equipment, as well as the equipment of common areas.
  2. The Guest shall be responsible for any damage caused to the room during the stay and hereby agrees to pay any costs for repairs, replacements or special cleaning. The amount of the payment shall be determined by the Hotel.
  3. The Guest is obliged to report any and all defects and deficiencies during the stay at the Hotel, so that their remedying can be arranged.
  4. The Guest shall be obliged to pay the costs associated with the accommodation services of the Hotel no later than on the day of arrival; no later than on the day of departure the Guest shall be obliged to pay other costs – additional services (sauna, restaurant services and other hotel services), unless otherwise agreed. In the event of non-payment of the amount, the Hotel shall be entitled to charge the corresponding amount to the Guest's payment card after the Guest´s departure.
  5. The Guest may terminate the contract under the cancellation conditions or in the event that the Hotel does not provide the Guest with pre-agreed services corresponding to the hotel standard.
  6. Check-in time is from 14:00 on the day of arrival. Early check-in is only possible after agreement with the Hotel and may be charged for.
  7. Check-out time is until 11:00 on the day of departure. Late check-out is possible by arrangement with the Hotel and may be charged for.
  8. The entire Hotel is non-smoking. Violation of this regulation and smoking in the Hotel's room or on its premises entitles the Hotel to charge the Guest a fine of EUR 200.00 for cleaning the Hotel's room or premises. Smoking is only permitted in front of the Hotel in the designated area.
  9. There is a night calm period between 22:00 and 6:00. Behaviour that disturbs other guests during the night calm period is strictly prohibited (this includes listening to loud music or television, shouting in rooms or corridors, and other disruptive behaviour). In the event of a serious breach of this rule, the hotel may fine Guests up to EUR 400.00 or, if necessary, call the police.
  10. Dogs can be accommodated free of charge upon confirmation by the Hotel.

HOTEL’S RIGHTS AND DUTIES:

  1. The Hotel shall provide accommodation for the Guest on the basis of pre-agreed services that correspond to the standard of the Hotel.
  2. In the event that the Hotel cannot accommodate the Guest on the basis of a pre-established and confirmed reservation, the Hotel shall be obliged to provide the Guest with adequate accommodation in another facility.

FINAL PROVISIONS

  1. These Terms and Conditions are valid from 1 November 2020 and the Hotel reserves the right to amend them, and the Guest is obliged to observe these valid Terms and Conditions.
  2. The Hotel collects the Guest´s personal data solely for the time strictly necessary until the conclusion of the provision of the agreed services and shall not provide such data to other third parties.

ÚČASTNÍCI SMLUVNÍHO VZTAHU

  1. firma Hotel Victoria s.r.o. se sídlem na adrese Borská 19, 30100 Plzeň, společnost je zapsána v obchodním rejstříku, vedeného krajským soudem v Plzni oddíl C, vložka 11242 (dále jen jako „Hotel“)
  2. objednatel – jako fyzická či právnická osoba (dále jen „objednatel“)Tyto podmínky platí obecně pro všechny hotelové Hosty a Agentury, se kterými není sjednána písemná smlouva o poskytování služeb.

REZERVACE UBYTOVÁNÍ A SLUŽEB:

  1. Rezervace ubytování a dalších služeb v Hotelu a potvrzení této rezervace ze strany hotelu je možné písemně, tj. emailem. či telefonicky
  2. Rezervace se považuje za platnou a závaznou v případě, že Hotel písemně tedy emailem potvrdí Hostovi provedenou rezervaci nebo automatické emailové potvrzení generované příslušným online rezervačním systémem.
  3. Rezervace je dokončena pomocí platební karty nebo uhrazením zálohy ve výši objednaného ubytování a služeb. Mohou být stanoveny individuální podmínky.
  4. V případě, že Hotel nebo Host nesplní podmínky, které jsou uvedeny v bodu 3., Hotel nemusí ubytování a služby poskytnout.
  5. Údaje, které jsou uvedeny na potvrzení rezervace jsou závazné pro obě strany

CENY, STORNOVACÍ A PLATEBNÍ PODMÍNKY:

  1. Cena je uvedena za pokoj na jednu noc, včetně snídaně, pokud nezvolí host jinak.
  2. V ceně ubytování je zahrnuto DPH ve výši 10%. Městský poplatek ve výši 21 CZK/osoba na noc je zahrnut v ceně ubytování.
  3. Zrušení potvrzené rezervace je možné učinit pouze písemnou formou, tedy emailem. Přesný způsob zrušení rezervace je daný rezervačním systémem, který byl pro rezervaci využit.
  4. Při zrušení rezervace, která byla zadána přes externí poskytovatele (např. booking.com) je nutné rezervaci zrušit taktéž přes tohoto poskytovatele způsobem, který poskytovatel vyžaduje a za podmínek rezervace.
  5. Změna rezervace, tj. přesun objednaných služeb na jiný termín je považován za zrušení původní rezervace a řídí se stejným režimem jako zrušení rezervace.
  6. Ubytování je možné uhradit v hotovosti, akceptujeme měnu CZK, EUR, USD, GBP, CHF. V případě platby kreditní/platební kartou bude účtována částka v měně CZK, EUR či USD dle vybrané měny.
  7. Podle zákona o evidenci tržeb je prodávající povinen vystavit kupujícímu účtenku. Zároveň je povinen zaevidovat přijatou tržbu u správce daně online, v případě technického výpadku pak nejpozději do 48 hodin.
  8. Hotel si vyhrazuje právo předběžné předautorizace karty Hosta až do výše celkové částky za ubytování.
  9. Při zrušení rezervace 24 před příjezdem (v případě standardní rezervace) nebude účtován žádný storno poplatek
  10. V případě volby nevratné rezervace má hotel právo účtovat 100% z ceny ubytování kdykoliv po vytvoření rezervace.
  11. V případě nedojezdu hosta je rezervace stornována a Hotel je oprávněn účtovat náklady na celý pobyt Hosta.

PRÁVA A POVINNOSTI HOSTA:

  1. Host má právo užívat rezervovaných prostor a jejich vybavení, stejně tak jako vybavení společných prostor
  2. Host je odpovědný za všechny škody způsobené v pokoji během pobytu a souhlasí s tím, že uhradí případné náklady na opravy, výměny nebo zvláštní čištění. Výše úhrady bude určena hotelem.
  3. Host je povinen veškeré závady a případné nedostatky reklamovat během svého pobytu v hotelu, aby mohla být sjednána náprava.
  4. Host je povinen nejpozději v den příjezdu uhradit náklady spojené s využitím ubytovacích služeb Hotelu, nejpozději v den odjezdu je pak host povinen uhradit ostatní náklady - doplňkové služby (sauna, restaurační služby a jiné hotelové služby), nebylo-li dohodnuto jinak. V případě neuhrazení částky je Hotel oprávněn účtovat odpovídající částku z platební karty hosta po jeho odjezdu.
  5. Host může odstoupit od smlouvy na základě stornovacích podmínek nebo v případě, že Hotel neposkytl Hostovi předem dohodnuté služby odpovídající standardu hotelu
  6. Doba přihlášení do hotelu je od 14:00 v den příjezdu. Dřívější přihlášení je možné pouze po dohodě s Hotelem a může být zpoplatněn.
  7. Doba odhlášení je do 11:00 v den odjezdu. Pozdní odhlášení je možné po dohodě s hotelem a může být zpoplatněno.
  8. Celý hotel je nekuřácký. Porušení tohoto nařízení a kouření v pokoji či prostorách hotelu opravňuje Hotel, aby Hostovi naúčtoval penále ve výši 200 EUR za vyčištění pokoje či prostor Hotelu. Kouření je možné pouze před Hotelem k místě tomu vyhrazeným.
  9. V rozmezí od 22:00 a 6:00 je doba nočního klidu. Chování, které vede k rušení ostatních hostů v době nočního klidu, je přísně zakázáno (zahrnuje hlasitý poslech hudby, televize, křik v pokojích, chodbách a další rušivé chování). V případě vážné porušení tohoto pravidla může hotel penalizovat hosty finanční pokutu a do výše 400 EUR nebo, v nutných případech, volat policii.
  10. Psi mohou být ubytováni na základě potvrzení Hotelu zdarma.

PRÁVA A POVINNOSTI HOTELU:

  1. Hotel je povinen pro Hosta zajistit ubytování na základě předem dohodnutých služeb, které odpovídají standardu Hotelu.
  2. V případě, že Hotel nemůže Hosta ubytovat na základě předem vytvořené a potvrzené rezervace, Hotel má povinnost zajistit pro Hosta adekvátní ubytování v jiném zařízení.

ZÁVĚREČNÁ USTANOVENÍ:

  1. Tyto podmínky jsou platné od 1.11.2020 a Hotel si vyhrazuje právo jejich změn a Host je povinen se řídit těmito aktuálními podmínkami.
  2. Hotel shromažďuje osobní údaje Hosta pouze po dobu nezbytně nutnou do ukončení poskytování sjednaných služeb a tyto údaje neposkytuje dalším osobám.

  2. Scope of Processing of Personal Data

    Personal data are processed in the scope in which the data subject has provided them to the controller in relation to the conclusion of a contractual or similar legal relationship with the controller or which have been collected by the controller in accordance with applicable legislation or to fulfil legal obligations of the controller.

    • address and identification data used for unambiguous and unmistakeable identification of data subjects – name, surname, date of birth, permanent address, citizenship, number of the travel document or another official proof of identity, visa number, purpose of the stay, signature and data to contact the data subject – contact details – e.g. contact address, phone number, e-mail address and other similar information.

    • other data necessary to perform the contract

    • data provided beyond the legal requirements, processed based on the data subject’s consent (use of personal data for marketing communications, personnel management etc.)

  7. Purpose of Processing of Personal Data

    • execution of orders, reservations, concluding and performing contracts related to the services offered and provided, as well as in cases prescribed by the law, particularly by Municipal Charges Act for the purpose of collecting fees for spa or recreational stays, or fees for accommodation capacity, the act on the residence of foreign nationals, where the provision of personal data is mandatory (in the above cases, HOTEL VICTORIA s.r.o. is in accordance with the provisions of Article 6(1)(b), (c), (f) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) entitled to process your personal data without your consent).

    When making reservations on the controller’s website, personal data are required for successful booking (name, surname, phone, e-mail). The purpose of processing of personal data is to handle orders from data subjects and to exercise rights and obligations arising from the contractual relationship between the data subject (customer) and the controller. The purpose of processing of personal data is also sending of commercial communications and performing other marketing activities. The legal reason for processing of personal data is the fulfilment of the contract under Article 6(1b) of GDPR, performance of the controller’s legal obligation under Article 6(1c) of GDPR and the controller’s legal interest under Article 6(1f) of GDPR. The controller’s legitimate interest is the processing of personal data for marketing purposes.

  8. Method of Processing and Data Protection

    Processing of personal data is conducted by the controller. The processing is carried out in controller’s premises and registered office by authorised employees of the controller, or by the processor. The data are processed by the computer technology, or manually in the case of personal data in paper form, in compliance with all security policies for the management and processing of personal data.

    To this end, the controller has taken appropriate technical and organisational measures (in accordance with Article 25 of GDPR) to ensure the data protection, in particular, measures to prevent unauthorised and accidental access to personal data, their alteration, destruction or loss, unauthorised transfers, unauthorised processing, as well as other misuse of personal data. All entities to which personal data may be made available shall respect the data subjects’ right to privacy and proceed in accordance with applicable legislation related to data protection. The Provider is not involved in automated individual decision-making (including profiling) within the meaning of Article 22 of GDPR.

  9. Period of Processing of Personal Data

    In accordance with deadlines defined in the relevant contracts, the controller’s filing and shredding rules and in the relevant legal regulations, this is a period necessary to ensure the rights and obligations arising from the contractual relationship as well as from the relevant legal regulations.

  10. Guidance

    The controller processes data with the data subject’s consent, except where the data subject’s consent to the processing of personal data is not required by the law.

    In accordance with Article 6(1) of GDPR, the controller may process the following data without the data subject’s consent:

    1. the data subject has given consent to the processing of his or her personal data for one or more specific purposes;

    2. processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;

    3. processing is necessary for compliance with a legal obligation to which the controller is subject;

    4. processing is necessary in order to protect the vital interests of the data subject or of another natural person;

    5. processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;

    6. processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

  11. Rights of Data Subjects

    In accordance with Article 12 of GDPR, the controller will inform data subjects at their request about the right to access their personal data and the following information:

    1. purpose of processing,

    2. category of the personal data concerned,

    3. recipients or categories of recipients that have been or will be provided with access to personal data,

    4. planned period for which personal data will be stored,

    5. all available information on the source of personal data,

    6. if they are not obtained from the data subject, the existence of automated decision-making, including profiling.

    In relation to the controller, the data subject has the following rights:

    1. the right to access his/her personal data under Article 15 of GDPR,

    2. the right to rectification of his/her personal data under Article 16 of GDPR,

    3. the right to erasure, right to be forgotten under Article 17 of GDPR,

    4. the right to restriction of processing under Article 18 of GDPR,

    5. the right to data portability under Article 20 of GDPR,

    6. the right to object to processing under Article 21 of GDPR,

    7. the right not to be subject to a decision based solely on automated processing, including profiling, under Article 22 of GDPR.

    Each data subject who believes that the controller or processor processes his/her personal data contrary to the protection of data subjects’ privacy or contrary to the law, in particular, if the personal data are inaccurate with respect to the purpose of their processing, the data subject is entitled to:

    1. Ask the controller to provide an explanation.

    2. Ask the controller to remedy the situation. In particular, this may concern blocking, rectifying, completing or erasing personal data.

    3. If the data subject’s request pursuant to paragraph 1 found to be justified, the controller shall immediately remedy the situation.

    4. If the controller fails to satisfy the data subject’s request pursuant to paragraph 1, the data subject has the right to contact directly the supervisory authority, i.e. the Office for Personal Data Protection.

    5. The procedure described in paragraph 1 shall be without prejudice to the data subject’s right to contact directly the supervisory authority.

    6. The controller is entitled to require reasonable compensation for providing the information which does not exceed the costs necessary to provide such information.
